Information on personal data processing – GDPR CLAUSE

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as „GDPR”, we would like to inform you that:

Personal Data Administrator

The administrator of personal data is Janusz Kania conducting business activity under the name of Agregaty PEX POOL PLUS Janusz Kania, with its registered office in Dębica, 35 Metalowców Street, hereinafter referred to as „Agregaty PEX POOL PLUS Janusz Kania” or „Administrator”.

DATA PROVIDED BY CUSTOMERS AND CONTRACTORS

Agregaty PEX POOL PLUS Janusz Kania collects only the data necessary to achieve the purposes for which personal data are processed.

If legal provisions do not impose an obligation to process and collect specific data, Agregaty PEX POOL PLUS Janusz Kania collects the following data:

  • first name and last name,
  • company,
  • business address and correspondence addresses,
  • numbers held in appropriate registers (e.g. NIP or REGON number, PESEL number),
  • contact details, such as e-mail address or telephone or fax number,
  • position held within the organization or function performed,
  • experience or qualifications,
  • bank account number,
  • payment and delivery details, including billing address,
  • data from video monitoring that covers part of the workplace,
  • information about the browser or devices used to view the website Agregaty PEX POOL PLUS Janusz Kania.

DATA COLLECTED FROM OTHER SOURCES

Agregaty PEX POOL PLUS Janusz Kania may obtain personal data of Customers and Contractors from publicly available sources, such as CEIDG or KRS business registers in order to verify the information provided.

In such a case, the scope of data processed will be limited to data available publicly in appropriate registers.

Personal data may also be obtained from entities that employ you or represent you.

In such a case, the scope of data processed will include information necessary to handle cooperation and contact with the Contractor, e.g. information about the termination of your employment with a given entity or change of contact details.

Personal data may be obtained from contractors’ subcontractors who provided Agregaty PEX POOL PLUS Janusz Kania with such data in order to support cooperation between the Contractor and Agregaty PEX POOL PLUS Janusz Kania.

OBJECTIVES AND BASIS OF PROCESSING

Personal data is processed only for a specific purpose and to the extent necessary to achieve it and for as long as necessary.

The basic goals that the Agregaty PEX POOL PLUS Janusz Kania achieve through data processing are listed below:

  1. conclusion and implementation of the contract, including the quality guarantee contract (if granted),
  2. fulfillment of obligations arising from legal provisions, including issuing VAT invoices and fulfilling obligations under the warranty for defects,
  3. determining, investigating or defending against claims under the contract, including a warranty contract in the event of a dispute,
  4. direct marketing,
  5. other than those indicated above – based on the Customer’s consent.

In the case of concluding a contract directly between the Customer and Agregaty PEX POOL PLUS Janusz Kania, providing the data specified above is voluntary, but necessary for the purposes of concluding the contract and handling cooperation between the Customer and Agregaty PEX POOL PLUS Janusz Kania.

If you do not conclude a contract directly with Agregaty PEX POOL PLUS Janusz Kania, providing personal data may be your official duty or may be necessary to conclude a contract between you and a third party (e.g. when you are a subcontractor of the Contractor).

The consequence of failure to provide data is the inability to perform the above activities by the Agregaty PEX POOL PLUS Janusz Kania (for example, failure to provide data may result in the inability to perform or issue an invoice).

DATA STORAGE PERIOD

Personal data is stored for no longer than for the period necessary to achieve the purpose.

Personal data of Customers and Contractors are stored for the duration of the contract and after its implementation for the period necessary for the purposes for which they were collected, which will most often coincide with the limitation period for claims related to the contract.

Storing documentation for the purposes of demonstrating compliance with obligations arising from legal provisions, in particular the Accounting Act and the Tax Ordinance Act, is valid for the period indicated in the relevant legal provisions – as a rule, these are 5-year periods, counted from the end of the calendar year in which the e.g. issuing an invoice.

Personal data of Customers and Contractors processed for direct marketing purposes will be stored no longer than until the Customer or Contractor withdraws consent.

DATA RECIPIENTS

Personal data of Customers and Contractors – to the extent and in cases when required to achieve the purposes of personal data processing – are transferred to the manufacturer or supplier of goods, entities providing service, assembly, warranty, post-warranty, forwarding, transport, courier services, insurer (in the case of insurance by the Customer goods via the Administrator) and entities providing accounting services.

Customers’ personal data may also be transferred to law firms if it is justified by the need to resolve a dispute with the customer.

RIGHTS OF PERSONS TO WHOM THE DATA CONCERN

Every person has the right to access their personal data processed by Agregaty PEX POOL PLUS Janusz Kania.

The Customer and Contractor has the right to:

  • request rectification of his data,
  • request the deletion of personal data in cases specified in the provisions of the GDPR,
  • request to limit the processing of personal data in cases specified in the provisions of the GDPR,
  • to object for reasons related to your particular situation – to the processing of your personal data, if such processing is carried out for the purpose of pursuing the public interest or legitimate interests of Agregaty PEX POOL PLUS Janusz Kania or a third party,
  • data transfer, i.e. receive personal data provided to Agregaty PEX POOL PLUS Janusz Kania in a structured, commonly used and machine-readable format and to request that such personal data be transferred to another personal data controller, without hindrance from Agregaty PEX POOL PLUS Janusz Kania and subject to its own confidentiality obligations,
  • withdraw consent in the event that Agregaty PEX POOL PLUS Janusz Kania obtains such consent to the processing of personal data (provided that such withdrawal will not affect the lawfulness of data processing carried out before the withdrawal).

LODGING A COMPLAINT ABOUT DATA PROCESSING

In the event of becoming aware of unlawful processing of personal data by Agregaty PEX POOL PLUS Janusz Kania, the right to lodge a complaint with the supervisory authority competent for the protection of personal data, i.e. President of the Personal Data Protection Office (Prezesa Urzędu Ochrony Danych Osobowych).

TRANSFER OF PERSONAL DATA OUTSIDE THE EEA AND TO INTERNATIONAL ORGANIZATIONS

The personal data provided will not be transferred to third countries or international organizations.

AUTOMATED DECISION MAKING AND PROFILING

Personal data of the Customer and Contractor may be processed in an automated manner, including in the form of profiling, however, profiling may only take place to the extent that it is permissible under the legitimate interest of the Administrator, and to a broader extent – on the basis of a separate consent. Customer.

Profiling based on the legitimate interest of the Administrator will consist in offering the Customer a product or after-sales service (e.g. inspection or maintenance of the goods), best suited to the Customer, but binding decisions will not be automated.
