INFORMATION CLAUSE FOR NATURAL PERSONS ENTERING THE PREMISES OF AGREGATY PEX POOL PLUS

This clause is addressed to natural persons who enter the premises of AGREGATY PEX POOL PLUS Janusz Kania, (hereinafter referred to as the „You”). Personal data is collected in connection with the round-the-clock security of the area supervised by AGREGATY PEX POOL PLUS Janusz Kania, including in connection with the operation of the access control system and video surveillance in the area of AGREGATY PEX POOL PLUS Janusz Kania.

In accordance with Article 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as „GDPR”), we would like to inform you that:

PERSONAL DATA ADMINISTRATOR

The PERSONAL DATA ADMINISTRATOR is Janusz Kania, running a business under the name Agregaty PEX POOL PLUS Janusz Kania, based in Dębica, Metalowcy 35 Street, hereinafter referred to as „Agregaty PEX POOL PLUS Janusz Kania” or „Administrator”.

SCOPE OF DATA PROCESSED

The scope of personal data processed by us includes the following personal data:

  • name, surname,
  • Address
  • number of the document confirming identity/PESEL number,
  • CCTV images and other data that indirectly identifies you (such as vehicle registration numbers).

We collect your personal data either directly from you or from individuals who provide your personal information during the pass issuance process.

In the case of video surveillance, data is collected automatically by recording the image and other data enabling the identification of the identity through the monitoring system.

OBJECTIVES AND BASIS OF PROCESSING

Your personal data will be processed:

  1. in order to comply with a legal obligation to which the Administrator is subject (Article 6(1)(c) of the GDPR);

Processing is often necessary to comply with the Controller’s legal obligations or is expressly required by law.

The most important regulations on the basis of which the Controller processes your personal data include:

  • the Act on the Protection of Persons and Property,
  • provisions on the prevention of acts prohibited by law,
  • other regulations imposing obligations, recommendations or recommendations, issued by authorized state authorities or institutions.
  1. for purposes resulting from the legitimate interests pursued by the Administrator (Article 6(1)(f) of the GDPR); Processing may be considered necessary for the purposes of the legitimate interests pursued by the Administrator or a third party if it does not unduly affect your interests or fundamental rights and freedoms.

Examples of legitimate interests justifying the processing are:

  • ensuring the safety of people staying on the premises of Agregaty PEX POOL PLUS Janusz Kania,
  • ensuring the safety of property located on the premises of Agregaty PEX POOL PLUS Janusz Kania,
  • confidentiality of legally protected information,
  • handling complaints and inquiries,
  • determination or enforcement by the Administrator of civil law claims as part of its business.

DATA STORAGE PERIOD

Personal data is stored for no longer than for the period necessary to achieve the purpose.

  • Data that may be transferred to the competent state authorities, in particular the police, prosecutor’s office or courts in the event that the Administrator is obliged to do so under the provisions of law – stored for the period until the final conclusion of the proceedings.
  • Your personal data is processed to ensure the safety of people and property – 2 years from the moment you hand in your pass.
  • Your personal data is processed through the use of video surveillance Legitimate interests of the Controller – maximum 3 months.
  • Your personal data is processed in order for the Administrator to consider your inquiries Legitimate interests of the Administrator – the period necessary to complete the investigation.

Notwithstanding the above periods, your data may be processed for the purposes of establishing or pursuing civil law claims by the Administrator as part of its business, as well as defending against such claims – for the relevant limitation periods of such claims, i.e. As a rule, no longer than 6 years from the occurrence of the event giving rise to the claim.

DATA RECIPIENTS

Providing or entrusting your personal data may be necessary in order to perform the contract concluded by Agregaty PEX POOL PLUS Janusz Kania. This data may be shared or entrusted to the following entities:

  • entities providing services in the field of protection of persons and property, including those operating video surveillance,
  • suppliers of ICT systems and monitoring systems used by Agregaty PEX POOL PLUS Janusz Kania in this process, as well as entities providing maintenance services for these systems.

CCTV recordings may also be forwarded to the competent authorities, in particular the Police, the prosecutor’s office or courts, in the event that Agregaty PEX POOL PLUS Janusz Kania is obliged to do so under the provisions of law or for the purpose of pursuing possible claims by Agregaty PEX POOL PLUS Janusz Kania or defending against claims.

RIGHTS OF PERSONS TO WHOM THE DATA CONCERN

Your rights in relation to the processing of your data

  • the right to request access to your personal data,
  • the right to request rectification,
  • the right to request erasure,
  • the right to request the restriction of data processing,
  • the right to request data portability,
  • the right to object to the processing of your data.

LODGING A COMPLAINT ABOUT DATA PROCESSING

In the event of becoming aware of unlawful processing of personal data by Agregaty PEX POOL PLUS Janusz Kania , the right to lodge a complaint with the supervisory authority competent for the protection of personal data, i.e. President of the Personal Data Protection Office (Prezesa Urzędu Ochrony Danych Osobowych).

INFORMATION ON THE VOLUNTARYNESS OF PROVIDING DATA

Providing your personal data collected by the Administrator is not directly required by law and is voluntary, but the consequence of not providing the required data is the inability to enter the premises.
